Terms and Conditions of Use

1. Acceptance of Terms
These Terms and Conditions of Use (the “Terms”) govern access to and use of the website antiguafinehomes.com and its subdomains (the “Site”), operated by Antigua Fine Homes, S.A., a corporation organized under the laws of the Republic of Guatemala, with its registered address at 4a Calle Oriente No. 44, Antigua Guatemala, Sacatepéquez, Guatemala 03001, operating commercially under the brand Century 21 Antigua Fine Homes (“Antigua Fine Homes,” “we,” “us,” or “the Company”).
By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agreed to these Terms, as well as our Privacy Policy. If you do not agree with these Terms, please do not use the Site.
2. Description of the Site
The Site is a real estate portal dedicated to the promotion, marketing, and dissemination of properties for sale or rent in Guatemala, with emphasis on the regions of Antigua Guatemala, Lake Atitlán, Guatemala City, the Pacific Coast, and surrounding areas.
The Site offers property information, agent profiles, editorial content, search tools, and features for registered users including saved searches, favorite properties, and automatic alerts.
3. Nature of the Company
Antigua Fine Homes is a real estate brokerage operating under the Century 21 franchise. Properties published on the Site may be listed exclusively by Antigua Fine Homes or shared with other brokers through cooperation agreements, including multiple listing systems (MLS) such as the Omni system of Central America and the Century 21 Global Referral Network.
4. Property Information
4.1 Sources of Information
Information published about properties is obtained from sources we believe to be reliable, including owners, selling agents, developers, MLS systems, and public records. However, Antigua Fine Homes does not guarantee the accuracy, completeness, or timeliness of such information.
4.2 Independent Verification
All published information —including prices, measurements, construction areas, land areas, number of bedrooms, amenities, features, photographs, descriptions, location, legal status, and documentation— must be independently verified by the interested buyer or tenant before making any purchase, lease, or investment decision.
4.3 Changes and Availability
Prices, conditions, availability, and any other characteristics of properties are subject to change without notice. A property published on the Site may be withdrawn from the market, sold, rented, or modified in its conditions at any time. Publication of a property on the Site does not constitute a binding offer.
4.4 Photographs, Videos, and Visual Representations
Photographs, videos, renderings, floor plans, and other visual representations of properties are for illustrative purposes only. There may be differences between the images and the current physical condition of the property. Some images may have been digitally enhanced for presentation purposes.
4.5 Information Reserved for Qualified Buyers
Certain detailed information about specific properties —including condominium reports, financial documents, technical studies, maintenance fee analyses, seller information, and comparable documents— is made available only to qualified buyers. Antigua Fine Homes reserves the right to request documentation verifying the applicant’s identity, financial capacity, or seriousness of interest before sharing such information.
5. Use of the Site
5.1 Use License
Antigua Fine Homes grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal and non-commercial purposes related to the legitimate search for properties.
5.2 Prohibited Uses
You agree not to:
- Use the Site for illegal, fraudulent, or unauthorized purposes
- Copy, reproduce, distribute, modify, or create derivative works from Site content without express authorization
- Use automated systems, bots, crawlers, scrapers, or similar tools to extract information from the Site on a mass scale

- Interfere with the operation of the Site or compromise its security
- Republish listings, photographs, or other Site content on other portals without prior written authorization
- Use Site information for commercial purposes other than genuine property searches (for example, building competing real estate databases)
- Submit false or misleading information or impersonate another person
- Transmit viruses, malware, or any malicious code
5.3 Consequences of Misuse
Antigua Fine Homes reserves the right to suspend or cancel access to the Site of any user who violates these Terms, without prejudice to legal actions that may apply.
6. User Accounts
6.1 Registration
To access certain features of the Site (saved searches, favorites, new property alerts), creating a user account is required. By registering, you agree to:
- Provide truthful, complete, and up-to-date information
- Maintain the confidentiality of your access credentials
- Not share your account with third parties
- Notify us immediately of any unauthorized use of your account
6.2 Responsibility
You are responsible for all activity that occurs under your account. Antigua Fine Homes will not be liable for losses or damages arising from unauthorized use of your account when due to negligence in safeguarding your credentials.
6.3 Account Cancellation
You may delete your account at any time from your account settings or by writing to us at [email protected]. Antigua Fine Homes reserves the right to suspend or delete inactive accounts or accounts that violate these Terms.
7. Intellectual Property
7.1 Site Content
All Site content —including but not limited to text, photographs, videos, logos, designs, graphics, trademarks, databases, software, and its general presentation— is the property of Antigua Fine Homes, its licensors, or the owners of listed properties, and is protected by Guatemalan intellectual property laws and applicable international treaties.
7.2 Trademarks
“Century 21” and associated logos are registered trademarks of Century 21 Real Estate LLC and its affiliates, used under license. “Antigua Fine Homes” and distinctive brand elements are the property of Antigua Fine Homes, S.A.
7.3 Authorized Use
You may view, print, or download content from the Site only for personal and non-commercial use. Any other use, including reproduction, republication, or distribution, requires prior written authorization.
8. Contact Forms and Consent
By submitting a contact form, property inquiry, account registration, or any other form on the Site, you:
- Acknowledge having read and accepted these Terms and the Privacy Policy
- Authorize Antigua Fine Homes to contact you through the means provided to follow up on your inquiry

Publication of a property on the Site or submission of an inquiry through the Site does not create a brokerage, legal representation, fiduciary, or professional relationship between you and Antigua Fine Homes. Such a relationship is established only through the signing of a written brokerage, representation, or professional services contract.
11. Indemnification
You agree to indemnify, defend, and hold harmless Antigua Fine Homes, its directors, employees, agents, and affiliates from any claim, damage, loss, cost, or expense (including reasonable legal fees) arising from:
- Your use of the Site in violation of these Terms
- The information you provide through the Site
- Your violation of third-party rights
- Your non-compliance with applicable law
12. Changes to Terms
Antigua Fine Homes reserves the right to modify these Terms at any time. Changes will take effect on the date of publication on the Site. Your continued use of the Site after publication of changes constitutes your acceptance of the modified Terms.

13. Termination
Antigua Fine Homes may suspend or terminate your access to the Site at any time, with or without cause, with or without prior notice. Provisions on intellectual property, limitation of liability, indemnification, and governing law shall survive termination.

15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Guatemala. Any controversy, dispute, or claim arising from or related to these Terms or the use of the Site shall be submitted to the exclusive jurisdiction of the competent courts of the department of Sacatepéquez, Guatemala, with the parties waiving any other jurisdiction that may correspond to them.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Antigua Fine Homes regarding the use of the Site, and supersede any prior agreement or understanding on the same subject matter.
